TermsOfService

TheseTermsofService(TOS)formtheintegralpartoftheServerRentalAgreementandmustbeobservedand

compliedwithbyallofoursubscribers,irrespectiveofthetypeofserversubscriberrents.

UseofMMGN Services Group LLC.ServicesconstitutesacceptanceandagreementtoMMGN Services Group LLC.'sAUP

(AcceptableUsePolicy)aswellastheseTermsofService.

1.ServiceRates

SubscriberacknowledgesthatthenatureoftheService(asdefinedintheServerRentalAgreement)furnishedandthe

initialratesandchargeshavebeencommunicatedtoSubscriberintheServerRentalAgreement.Subscriberisaware

thattheCompanymayprospectivelychangethespecifiedratesandchargesfromtimetotime.Anypromotionaloffer

iscontingentuponCompanyachievingandmaintainingitscostofservicegoalsincludingbutnotlimitedtorates

chargedtocompanybyitssuppliers.

2.Limitations

Specificports(25/TCP/UDP,465/587/389/3389/TCP,111/UDP,137/138/139/TCP/UDP,445/TCP/UDP)areblocked

bydefaultforsecurityreasonsfordailydedicatedserversandVPS.

3.PaymentandTaxes

EstablishmentofthisserviceisdependentuponreceiptbytheCompanyoftheexecutedServerRentalAgreementand

paymentofstatedcharges.

1.MonthlyService

Subsequentpaymentsaredueonemonthafterthepurchasedateforthefollowingmonth'sservice.Allaccounts

andservicesprovidedbyMMGN Services Group LLC.aresubjecttothecurrenttaxrateasimposedbytheprovinceof

Florida and EE.UU.

2.DailyService

Subsequentpaymentsaredueonthefirstdateofthedailysubscriptionrenewaloftheservice.Allaccountsand

servicesprovidedbyMMGN Services Group LLC.aresubjecttothecurrenttaxrateasimposedbytheprovinceof

Florida and EE.UU.

4.RefundandDisputes

AllpaymentstoMMGN Services Group LLC.arenon-refundable.Thisincludestheonetimesetupfeeandsubsequent

chargesregardlessofusage.Alloverchargesorbillingdisputesmustbereportedwithin30daysofthetimethe

disputeoccurred.Ifyoudisputeachargetoyourcreditcardissuerthatisproventobeavalidchargeunderthe

provisionsoftheTOSand/orAUP,youagreetopayMMGN Services Group LLC.an"AdministrativeFee"ofUSD$100.

5.ProofofCardOwnership

Duetohighvolumeofidentitytheftanduseofstolenpaymentcards,MMGN Services Group LLC.canasktheSubscriberto

provideavalidphotoidentificationtoprovetheownershipofthepaymentcardiftheSubscriberusestheonline

paymentsystemtopayfortheServices.TheCompanykeepsallprivateinformationinaccordancewiththetermsof

section15below.

6.ServiceLevelAgreement(SLA)

a.TheCompanyguaranteesnetworkuptimetobe99.9%.Thisguaranteeassuresthatallmajorroutingdevices

withinournetworkarereachablefromtheglobalInternet99.9%ofthetime.

b.Exclusions:

1.ScheduledNetworkMaintenance-occasionallynetworkmaintenancewillberequired.TheCompany

willdoeverythingpossibletominimizeandavoiddowntimeduringthismaintenance.Subscriberwill

receivepriornotificationofupcomingmaintenanceatthee-mailaddresswehaveonfile.Scheduled

maintenanceperiodsarenoteligibleforSLAcredits.Customerswillbenotifiedinadvanceofthe

upcomingmaintenanceservice.

2.HardwareMaintenance-onrareoccasions,thehardwaremayneedmaintenanceorreplacement.

TheCompanywilldoeverythingpossibletominimizeanydowntimeinthesesituationsperour

hardwarereplacementSLA.Anydowntimeincurredasaresultofthismaintenancewillnotbecounted

towardsournetworkSLA.

3.SoftwareMaintenance-animportantpartofmanagingadedicatedserveriskeepingthesoftwareup

todate.IfSubscriberchoosestohavetheCompanymanageyourserver,occasionalsoftwareupdates

willberequiredtoaddresssecurityorperformanceissues.Usually,Subscriberwillexperiencelittleor

nodowntimeinthesesituations,buttheCompanycannotguaranteeaspecificamountoftimeinall

situations.

4.MaliciousAttacks-ifathirdpartynotassociatedwiththeCompanyinitiatesa"DenialofService"or

otherformofdisablingattackagainstSubscriber’sdedicatedserverormajorportionsofournetwork,

theCompanywilldoeverythinginitspowertostoptheattack,butcannotguaranteearesolutiontime.

5.LegalActions-InthecasethatalegalactionistakenagainstacustomeroftheCompanyandthe

Companyisrequiredtoactinaccordancewiththeorder,theCompanyshallnotberesponsibleforany

SLAdamages.

c.Backup.OursystemautomaticallyBackupyourVPSfortheCompany'sdisasterrecoverypurposes

weekly,andcannotguaranteedataconsistency.ThereforeyouareRESPONSIBLEfortheBackupand

archiveofyourcontentusingotherservices.

d.Remedy:IntheeventthattheCompanydoesnotmeetthisSLA,ourclientsbecomeeligibletorequest

compensationfordowntimereportedbyservicemonitoringlogs.IftheCompanyisorisnotdirectly

responsibleforcausingthedowntime,Subscriberwillreceiveacreditfor12timestheactualamountof

downtime.ThismeansthatifSubscriber’sserverisunreachablefor5minute,youwillreceive1hourof

credit.

Allrequestsforcompensationmustbereceivedwithin5businessdaysoftheincidentinquestion.The

amountofcompensationmaynotexceedthecustomer’smonthlyrecurringcharge.ThisSLAdoesnot

applyforanymonththatSubscriberhasbeeninbreachoftheCompany’sTermsofServiceorifthe

accountisindefaultofpayment.

7.FailuretoPay

TheCompanymaytemporarilydenyserviceorterminatetheServerRentalAgreementinaccordancewithsection5

belowuponthefailureofSubscribertopaychargeswhendue.SuchterminationordenialwillnotrelieveSubscriber

ofresponsibilityforthepaymentofallaccruedcharges.

8.DefaultandNotifications

1.MonthlyService

i.1daybeforetheendofthesubscriptionperiod,MMGN Services Group LLC.willnotifythesubscriberthattheservice

willbeblockedin1day.

ii.Onceabillisoverdue,MMGN Services Group LLC.willsendtheSubscriberaFirstDefaultNotification,andtheservice

willenterintoa'suspendedstate'.

iii.Onceabillis3daysoverdue,MMGN Services Group LLC.willsendtheSubscriberaFinalDefaultNotification,and

Serviceswillbeterminated,allexistingdataoftheSubscriberwillbedeleted.

iv.TheSubscriberwillnotbeterminatedorchargedthelatefeeifthedefaultisclearedpriortotheFinalDefault

Notificationissuance.

2.DailyService

i.MMGN Services Group LLC.willsendtwoEnd-of-ServiceNotificationstotheSubscriber12hoursand1hourpriorto

theendofthedailyserviceterm.TheSubscriberhastorenewitsdailysubscriptionorstartamonthly

subscription,otherwiseupontheendofthedailyserviceterm,allexistingdataoftheSubscriberwillbedeleted.

ii.TheFinalnotificationthattheagreementtermhasexpiredandalldatahasbeendeletedwillbesenttothe

Subscriberimmediatelyafterthedailyservicetermends,providedtheSubscriberhasnotreneweditsdaily

subscriptionorstartedamonthlysubscription.

9.ServersCancellation

Subscriberscancanceltheirserversatanytimethroughtheironlineaccounts.

10.TerminationduetoLimitedTechnicalCapacity

TheCompanymayatanytimedenyserviceorterminatetheServerRentalAgreementifitdoesnothaverequired

technicalcapacitytoperformtheservice.SuchterminationordenialwillnotrelieveSubscriberofresponsibilityfor

thepaymentofallaccruedcharges.AllpaymentsmadebutunusedbySubscriberduetotheterminationin

accordancewiththissectionwillberefundedbytheCompanytoSubscriber.

11.LimitedLiability

TheSubscriberacknowledgesthattheServiceprovidedisofsuchnaturethatServicecanbeinterruptedformany

reasonsotherthanthenegligenceoftheCompanyandthatdamagesresultingfromanyinterruptionofServiceare

difficulttoascertain.Therefore,theSubscriberagreesthattheCompanyshallnotbeliableforanydamagesarising

fromsuchcausesbeyondthedirectandexclusivecontroloftheCompany.TheSubscriberfurtheracknowledgesthat

thecompany’sliabilityforitsownnegligencemaynotinanyeventexceedanamountequivalenttochargespayable

bytheSubscriberforservicesduringtheperioddamagesoccurred.Innoeventshallthecompanybeliableforany

specialorconsequentialdamages,lossorinjury.

12.DisclosuretoLawEnforcement

TheAUPspecificallyprohibitstheuseofourServiceforillegalactivities.Therefore,theSubscriberagreesthatthe

CompanymaydiscloseanyandallSubscriberinformationincludingassignedIPnumbers,accounthistory,account

use,etc.toCanadianlawenforcementagentswithoutconsentornotificationtotheSubscriber.MMGN Services Group LLC.

willnotdisclosesubscriberinformationtoanythirdpartyorinternationalagencyunlessaCanadiancourtorderis

obtained.Inaddition,MMGN Services Group LLC.shallhavetherighttoterminateallservicesetforthinthisAgreement.

13.SupportBoundaries

MMGN Services Group LLC.provides24x7technicalsupporttooursubscribers.Welimitourtechnicalsupporttoourarea

ofexpertise.

MMGN Services Group LLC.providessupportonlyrelatedtoyourserver’sphysicalfunctioning.MMGN Services Group LLC.does

notoffertechnicalsupportforapplicationspecificissuessuchasCGIprogramming,HTMLoranyothersuchissue.

MMGN Services Group LLC.doesnotprovidetechnicalsupportforsubscribers’customers.

Supportisprovidedexclusivelythroughourticketingsystemathttps://cp.gthost.com.Phonerequestsarenot

accepted.

14.Inbound/OutboundDDoSAttacks

DDoSisanacronymforDistributedDenialofServiceAttack,whichisatypeofdenialofserviceattackinwhichan

attackerusesmaliciouscodeinstalledonvariouscomputerstoattackasingletarget.Anattackermayusethismethod

tohaveagreatereffectonthetargetthanispossiblewithasingleattackingmachine.AsauserofourServices,you

areultimatelyresponsibleformakingsurethatyouraccountissecured,andthatnorootkitsorvirusesareonyour

server.

UponnotificationofanallegedDDoS,whethersubscriber’sserverhasbecomethevictimofaDDoSAttackor

subscriberisdeliberatelyperformingtheDDoS,MMGN Services Group LLC.mayinitiateanimmediateinvestigation.During

theinvestigation,MMGN Services Group LLC.mayrestrictsubscriber’saccesstothenetworktopreventfurtherviolations.

IfasubscriberisfoundtobeinviolationofourDDoSpolicy,MMGN Services Group LLC.may,atitssolediscretion,

restrict,suspendorterminatesuchsubscriber'saccount.

AsalloursubscribersareultimatelyresponsiblefortheactionsoftheirclientsovertheMMGN Services Group LLC.

network,itisadvisablethateachsubscriberdevelopsasimilar,orstricter,policyfortheirclients.

15.PrivacyPolicy

Wereceiveandstoresubscribers’privateinformation.Theinformationyouprovideandthatiscollectedisusedto
